Fan Art Licensing Agreement

By submitting any art (the “Artwork”), you affirm that you (a) are eighteen (18) years or older, (b) are the sole creator and owner of the Artwork, and (c) have full authority to submit the Artwork. You further grant Technoblade, together with its agents, affiliates, successors, and assigns (collectively “Technoblade”) a perpetual and world-wide license to publish, display, promote, and otherwise use the Artwork for its own marketing and promotional purposes. You understand Technoblade may display the Artwork on social media, the Technoblade website, or in any other place, including in promotional and marketing materials, or for any other purpose. Technoblade will not use the Artwork for any product without your express written permission. This license shall not be exclusive to Technoblade, and you will retain all copyright and ownership of the intellectual property in and to the Artwork.

In the event the rights in and to the Artwork cannot be licensed to the extent required by this licensing agreement pursuant to the local law in which the Licensor resides, the foregoing licensing of rights shall be modified to the extent necessary to comply with such local law while giving Technoblade the maximum rights possible to use and exploit the Artwork.

I hereby indemnify, discharge, release, and hold harmless Technoblade from any action and/or liability, in any form or manner, arising from any infringement of any third party’s rights in connection with the Artwork or from the breach of any term of this Agreement.

Nothing contained in this Agreement shall be deemed to constitute a partnership between or a joint venture with Technoblade. 

This Agreement shall be governed by and construed in accordance with the State of Arkansas. The parties expressly understand and agree that any dispute arising under this Agreement will be brought only in the state of Arkansas.
